This petition is filed by the petitioner to quash the proceedings in Crime No.117 of 2011 on the file of III Town Police Station, Ananthapur.

Heard the counsel for the petitioner and the Public Prosecutor, who appears for the 1st respondent. None appears for the 2nd respondent in spite of notice.

The counsel for the petitioner takes this court through the allegations in the complaint.

A perusal of the complaint shows that the petitioner abused the complainant in her caste name. Hence, the plea of the petitioner's counsel to quash the proceedings against this petitioner with regard to Section 3(1)(x) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short 'the SC/ ST Act') cannot be considered. As regards the allegations constituting the other offences alleged are concerned, there are specific allegations against this petitioner that she has been harassing the complainant.

Hence, this is absolutely not a fit case where the proceedings can be quashed.

With the above observations, the Criminal Petition is dismissed. Interim stay granted by this court on 17.10.2011 in

Crl.P.M.P.No.9499 of 2011 shall stand vacated. As a sequel, the miscellaneous applications, if any pending, shall stand closed.
