THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21698 OF 2004 ORDER:

When the matter is taken up for hearing, learned counsel for the petitioners submits that the petitioners filed this writ petition seeking writ of mandamus declaring Staff Circular No. 23 dated 10/16-11-2004 of respondent No. 1 as arbitrary and illegal and against the Regional Rural Banks (Appointment and Promotion of Officers and Other Employees) Rules, 1998, and the judgment reported in 1998 (6) SCC 720 and consequently direct the respondents to start the selection process afresh based on the vacancies year wise by restricting the zone of consideration of the candidates for promotion to four times the number of vacancies available for promotion.

On 29-11-2004, this Hon'ble Court was pleased to grant the following interim direction:

"There shall not be any stay for written examination. However, it is made clear that at the time of finalization of merit candidates, who have secured minimum qualifying marks for interview, the respondents are directed to notify the bench mark." Learned counsel for the petitioners submits that in view of the interim orders, the promotion exercise has been concluded and the cause in the writ petition will not survive for adjudication. 3.

This Court having considered the above said submission of learned counsel for the petitioners is of the considered view that since promotion exercise has been completed during the year 2004-05 itself, the cause in the writ petition does not survive.

The writ petition is accordingly dismissed. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
