ORDER

On behalf of the District Cooperative Central Bank Limited, Vizianagaram, at long distance of time on 10.12.2015, a sum of Rs.2,76,926/- has been settled and paid to the petitioner. There is no doubt, a statement is made that leave encashment amount representing of Rs.1,10,299/- has been withheld in view of pendency of O.A.No.1 of 2013 on the file of Andhra Pradesh Cooperative Tribunal, Visakhapatnam. As to how far the Bank is justified in withholding the payment of Rs.1,10,299/- cannot be speculated in a contempt proceedings and it is open to the petitioner to work out his remedies as available under law, insofar as this amount is concerned. If there are still any dues, which are liable to be settled by the respondent Bank, it is open to the petitioner to work out his remedies in accordance with law.

However, now it is brought to the notice of this Court that the petitioner himself has given an undertaking. Therefore, in these set of circumstances, the Contempt Case is disposed of preserving all such liberties which the petitioner has to work out his remedies under law. No order as to costs. Miscellaneous petitions, if any, pending in this contempt case are closed.
