HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18561 of 2006 ORDER :
When the matter is taken up for hearing, learned counsel for the petitioner submits that when promotion was offered to the petitioner to the next higher post, he did not join in the promoted post and the respondents have treated the same as permanent relinquishment of promotion by the petitioner. Learned counsel for the petitioner further submits that similar issue was considered by this Court in W.P.No.8402 of 2013, wherein this Court had considered the amended Rule 11(b) of the A.P. State and Subordinate Service Rules, 1996, vide G.O.Ms.No.145, General Administration (Ser.D) Department, dated 15.06.2004, and contends that the petitioner is entitled for promotion in terms of the said G.O.
Learned counsel further submits that since the petitioner has attained the age of superannuation during the pendency of the writ petition, appropriate orders be passed directing the respondents to consider the case of the petitioner notionally in terms of the above G.O.Ms.No.145, dated 15.06.2004. Having considered the above submission, this Court is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation seeking promotion in terms of G.O.Ms.No.145, General Administration (Ser.D) Department, dated 15.06.
AKS, J W.P.No.18561 of 2006 representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.
With the above observations, the writ petition is disposed of. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
