HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD WRIT APPEAL No. 1453 of 2014 JUDGMENT: (per HACJ) Sri M. Rajender Reddy, learned counsel for the respondent-writ petitioner, submits that the writ petition was filed by the 1st respondent herein questioning the inaction of the Government of India in enforcing Section 34 of the A.P. Reorganisation Act, 2014, and in issuing necessary instructions to respondents 2 to 4 (the appellant, and respondents 2 and 3 herein) to perform their functions provided in the Advocates Act, 1961, with respect to the Bar Counsel of the State of Telangana, as illegal, arbitrary and contrary to the provisions of the A.P. Reorganisation Act, 2014, and the Advocates Act, 1961.

Learned counsel would further submit that the petitioner, a Law Graduate, had filed the writ petition contending that he cannot be forced to enroll with the Bar Council of A.P., and that a separate Bar Council for the State of Telangana should be constituted; after the writ petition was allowed, the petitioner has enrolled himself with the Bar Council of A.P. on 10.09.2015; in the light of his enrolment with the Bar Council of A.P., the cause in the writ petition itself does not survive; and, instead of keeping the appeal pending on the file of this Court, it would suffice if the writ petition itself is dismissed as withdrawn.

As the respondent-writ petitioner himself seeks permission to withdraw the writ petition, suffice it if the order under appeal is set aside, W.P.No.17676 of 2014 is restored to file, and is dismissed as withdrawn.
