HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE MS. JUSTICE J. UMA DEVI WRIT PETITION NOs.28293 AND 28300 OF 2017 COMMON ORDER: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) In both these Writ Petitions, the action of the respondents in issuing memo dated 21.08.2017 directing all political functionaries, including the petitioners who came from other Districts, to leave Kurnool District as the model code of conduct was in force in the entire Kurnool District in view of the Bye-Election to 139-Nandyal Assembly Constituency, is questioned as being arbitrary, illegal and contrary to law.

Elections to the Nandyal Assembly constituency was held on 23.08.2017, and the result of the elections were declared on 28.08.2017. As the bye-election to the Nandyal Assembly Constituency has already been held, and the result of the elections declared, the cause in both these Writ Petitions do not survive necessitating any further adjudication by this Court. Both the Writ Petitions have become infructuous and are, accordingly, dismissed. The miscellaneous petitions pending, if any, shall stand closed. No costs.
