This writ petition is filed seeking a writ of Mandamus declaring the inaction on the part of the third respondent in disposing of the representation of the petitioner dated 28.07.2016 as illegal and arbitrary.

Heard Sri P.V.S.A.Rama Murthy, learned counsel for the petitioners, the learned Government Pleader for Industries (Andhra Pradesh), representing the respondents 1 and 2, learned Government Pleader for Revenue (Andhra Pradesh) representing the 3rd respondent, learned Government Pleader for Animal Husbandry(Andhra Pradesh) representing the 7th and 8th respondents, learned Government Pleader for Panchayat Raj (Andhra Pradesh) representing 9th, 10th and 11th respondents, Sri Gurram Ramachandra Rao, learned standing counsel for Pollution Control, representing the respondents to 6, Sri Ravi Cheemalapati, learned standing counsel for Gram Panchayat representing the respondents 12 and 13.

It is the case of the petitioners that the second petitioner is the president of the first petitioner society. A perusal of the record reveals that the second petitioner obtained necessary permission from the concerned authorities for establishment of Mechanised Slaughter House with Cold Storage Unit in R.S.No.2/ 1, 2/ 3 of Jaldam Gram Panchayat, D.Paidipala village, Rowthulapudi

Mandal of East Godavari District. The petitioners submitted a representation to the third respondent on 28.07.2016 seeking permission for construction of the above said unit. For one reason or other, the third respondent has not disposed of the representation of the petitioners.

At the time of arguments, the only relief sought by the learned counsel for the petitioners is to direct the third respondent to dispose of the representation of the petitioner dated 28.07.2016 as expeditiously as possible. The learned Assistant Government Pleaders for Revenue and Panchayat Raj, learned standing counsel for Panchayat Raj are consented for the same. In view of the submissions made by the learned counsel for the petitioners, this Court is not inclined to go into the merits of the main case.

Having regard to the submissions made by both the counsel, the third respondent is hereby directed to dispose of the representation of the petitioner society dated 28.07.2016 as expeditiously as possible, preferably, within a period of eight weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No order as to costs. As a sequel, the miscellaneous petitions, pending if any in this writ petition, shall stand closed. ______________________ T.SUNIL CHOWDARY, J September 23, 2016.
