THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P. Nos.10845 AND 10846 OF 2015 AND CRIMINAL PETITION No.15758 OF 2013 ORDER:

The Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/A.1 to A.5 seeking to quash the proceedings in C.C.No.701 of 2014 (Old C.C.No.4031 of 2013) on the file of the Court of the XXIV Metropolitan Magistrate, Miyapur, arising out of crime No.316 of 2013 on the file of the Sanathnagar Police Station, registered for the offences under Sections 420 and 506 IPC.

Heard and perused the material available on record. When the case is taken up for hearing, learned counsel for the petitioners as well as counsel for de facto complainant/second respondent submit that they have filed Crl.M.P.Nos.10845 and 10846 of 2015 seeking permission of this Court to compound the offences and consequently, to quash the proceedings. Along with the said applications, they have filed the Joint Memo signed by the complainant as well as the petitioners and also the same is signed by the counsel for both the parties. Both the parties are present in the Court and asserted that they entered into compromise.

Considering the above, the petitioners and second respondent/de facto complainant are permitted to compound the offence. In view of the amicable settlement of the dispute between the parties, Crl.P.M.P.Nos.10845 and 10846 of 2015 are ordered and the compromise is recorded. Consequent thereto, the criminal petition is allowed and the proceedings in C.C.No.701 of 2014 (Old C.C.No.4031 of 2013) on the file of the Court of the XXIV Metropolitan Magistrate, Miyapur, is hereby quashed.

The Criminal Petition is accordingly allowed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 29.10.2015 pln
