Heard learned counsel for the petitioner and Sri P.Keshava Rao, standing counsel for C.B.I.

The petitioner prays for writ of Certiorari to quash FIR No.03/2013, CBI, BS&FC, Bangalore dated 06.07.2013 pending on the file of XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

At the time of hearing, the learned standing counsel submits that final report in RC-3 (E)/2013 is filed before the learned XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. According to the final report filed by respondent No.2, the petitioner herein is shown as A-6 and he is charged under Section 120-B r/w. 420 IPC. The prayer in the writ petition is to quash the FIR. With the filing of final report, the complexion of the case is completely changed. The writ petition is dismissed by leaving it open to the petitioner to work out available remedies, if any, against the final report. No order as to costs.
