HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CRIMINAL REVISION CASE No.437 of 2017 ORDER :

This Criminal Revision Case is filed by the petitioner/Accused aggrieved by the order dated 27.01.2017 in Crl.MP.No.129 of 2016 in C.C.No.320 of 2015 passed by the VII Additional Assistant Sessions Judge-cum-VI Additional Chief Metropolitan Magistrate (FAC), Vijayawada.

Heard learned counsel for the petitioner/Accused as well as the learned Public Prosecutor appearing for respondent No.1 and perused the material available on record.

Similar issue has been dealt with and decided by this Court vide order dated 23.08.2016 in C.R.P.No.1850 of 2015 between BUDDHA JAGADEESWARA RAO v. SRI RAVI ENTERPRISES, REP. BY ITS PROPRIETOR KEDARISETTY GURUMURTHY. In view of the same, there are no grounds to admit the present revision or keep it pending; but for right to oppose on admissibility of the document, apart from relevancy, is left open to the petitioner/Accused to raise before the lower Court, while marking, for the duty of the lower Court to decide, in the event of the document is a original, if required for stamp duty, leave about any registration also, if necessary, to impound or refer it to the District Registrar for impounding, as the case may be, and it is after duly impounding, if not duly stamped, then only the other objection regarding registration, if necessary, whether to admit for any collateral

Dr. SSRB, J Crl. R.C. No.437 of 2017 purpose, as contemplated under Section 49 r/w. Section 17 of the Registration Act, arises to consider and decide. 4.

Subject to the above, this Criminal Revision Case is disposed of. As a sequel, miscellaneous petitions pending, if any, in this revision shall stand closed.
