HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 3520 of 2019 ORDER:

1.

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.877 of 2017 on the file of the XXV Metropolitan Magistrate, Kukatpally at Miyapur. 2.

A charge sheet came to be filed against the petitioner and others for the offences punishable under Sections 420, 354, 342, 324 and 384 read with 34 IPC.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioner is not in dispute, his presence in the above C.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioner in C.C.No.877 of 2017 on the file of the XXV Metropolitan Magistrate, Kukatpally at Miyapur, is hereby dispensed with except on the dates when his presence is specifically required by the Court.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
