THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.4749 of 2017 ORDER:

This Writ Petition under Article 226 of the Constitution of India is filed seeking the following relief:

".... to issue a writ, order or direction more particularly one in the nature of writ of Mandamus declaring the seizer panchanama proceedings dt.16-10-2014 of Respondent no.4 in detaining Vehicle bearing No.AP 21 Y 2799 as illegal and arbitrary and consequently set aside the same as against this Petitioner and direct the Respondents 2 to 5 to release the Vehicle bearing No. AP 21 Y 2799 belonging to Petitioner as against this petitioner and to pass such other order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.

The grievance of the petitioner in this writ petition is that despite filing an application under Section 6A of the Essential Commodities Act, 1955, on 14.10.2016 for release the vehicle, no action has been taken by the respondents on the said application. Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court is of the view that ends of justice would be served if the 3rd respondent is directed to pass appropriate orders on the application said to have been filed by the petitioner on 14.10.2016 within a time frame. Accordingly, the Writ Petition is disposed of directing the 3rd respondent-Joint Collector, Kurnool, to pass appropriate orders on the application said to have been filed by the petitioner on

14.10.2016, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No order as to costs.
