THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.434 OF 2000 JUDGMENT:

This Second Appeal is filed, by the unsuccessful plaintiff, under Section 100 of C.P.C., assailing the judgment and decree dated 22.11.1999 passed in A.S.No.118 of 1987 on the file of the Court of the Additional Senior Civil Judge, Narasaraopet, wherein and whereby the judgment and decree dated 31.08.1987 passed in O.S.No.420 of 1982 on the file of the Court of II Additional Munsif Magistrate, Narasaraopet, dismissing the suit filed by the plaintiff for perpetual injunction, was confirmed.

Learned Standing Counsel for Municipality submitted that the Municipality has laid the road in the suit schedule property in pursuance of the land acquisition proceedings initiated by the first respondent-Municipality.

Learned counsel for the appellant submitted that in view of the submission made by the learned Standing Counsel for Municipality, the purpose of filing the second appeal has become infructuous.

Hence, the Second Appeal is dismissed as infructuous. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed. _________________________ T.SUNIL CHOWDARY, J Date: 14.11.2018 Ivd
