THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION No.49 OF 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents 1 to 3.

The prayer sought for in the writ petition is as under: " to issue order or direct ion or writ more particularly in the nature of writ of mandamus declaring the action of the Respondents No. 1 to 3 in permitting the Management of the Respondent No 4 to shift the Respondent No. 4 school from H.No.2-5-259, Nakkalagutta, Hanamkonda, Warangal District to H.No.2-6-1050, KLN Reddy Colony. Subedari, Hanamkonda, Warangal District as arbitrary, illegal, violative of principles of natural justice, contrary to Section 20 of the A P Education Act, contrary to Rule 5 of A.P.

Educational Institutions (Establishment Administration and control of Private Schools) Rules, 1986, infringe the fundamental rights guaranteed to the petitioner and also all the residents of the colony under Article 14 and 19 (1)(g), 21 of the Constitution of India consequently prohibit any such shifting of Respondent No. 4 School from H.No.2-5-259 Nakkalagutta, Hanamkonda, Warangal District to H.No. 2-6-1050, KLN Reddy Colony, Subedari, Hanamkonda Warangal District in the interest of justice." During the course of hearing, the learned counsel appearing for the petitioner brought to the notice of this Court that the 4th respondent has already shifted the school.

In view of the above, this Court is of the opinion that no further orders are required in the writ petition and the same is accordingly, closed. No costs.
