Heard the counsel for petitioner, and the learned Government Pleader for Civil Supplies (Telangana) for respondents.

The petitioner's grievance is that DCM Van bearing No.AP 36 W 9430 was seized by respondents pursuant to a panchanama dt.25.08.2015 on the ground that it was transporting Public Distribution System rice.

3. The petitioner seeks release of the said vehicle on the ground that the vehicle would get damaged since the enquiry under Section 6-A of the Essential Commodities Act, 1955 to be conducted by respondents against petitioner would take considerable time. 4.

The learned Government Pleader for Civil Supplies states that the subject vehicle be directed to be released to the petitioner subject to petitioner giving a bank guarantee for the value of the said vehicle as assessed by 2nd respondent.

5. In view of the said submission, the Writ Petition is disposed of directing 2nd respondent to release the above vehicle to petitioner subject to petitioner producing proof of

ownership of the vehicle and giving an undertaking that he would not alienate or encumber the vehicle and agree to produce it as and when required in the said enquiry, and also subject to petitioner furnishing a bank guarantee for the value of the said vehicle as assessed by 2nd respondent. Accordingly, the Writ Petition is disposed of. No order as to costs.
