HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3948 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/A.1 seeking to quash the proceedings against him in Crime No.32 of 2018 of Ibrahimpatnam Police Station, registered for the offences under Sections 420 of I.P.C. and 63 and 65 of C.A. Heard both the learned counsel for the petitioner as well as counsel for the second respondent/defacto complainant who would request the court to pass the order in terms of Section 41-A Cr.P.C. Having regard to the stage of the matter, this Court is of the considered view that the investigation shall be completed at the earliest. However, having regard to the nature of the accusation, the Investigating Officer shall strictly follow the guidelines of the Apex Court rendered in ARNESH KUMAR Vs. STATE OF BIHAR (1) and also follow the provision under Section 41-A Cr.P.C. towards the petitioners. In turn, the petitioners shall cooperate with the investigating agency for smooth completion of investigation. Accordingly, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending if any, shall stand closed.
