Heard the learned counsel for the petitioner and the learned Government Pleader for Revenue (AP) for the respondents 1 to 4. 2.

The Revenue Divisional Officer vide his proceedings dated 19.12.2017 accepted the application submitted by the fifth respondent for conversion of land in an extent of Acs.0.45 cents in Survey No.476/4 of Duppituru Village, Atchutapuram Mandal, Visakhapatnam District, to use for non-agricultural purposes under the Andhra Pradesh Land (Conversion for Non-Agricultural Purpose) Act, 2006 ("the Act", for brevity). The petitioner filed an appeal against the decision of the Tahsildar. The petitioner claims interest in the subject property. It appears the petitioner also instituted O.S.No.27 of 2018 on the file of the Court of the Principal Senior Civil Judge, Yellamanchili. Alleging that there is no decision made by the appellate authority and that her application to grant stay is not considered, the present Writ Petition is filed.

Section 8 of the Act provides remedy of appeal of any aggrieved person against order of the competent authority granting conversion of land for non-agricultural purposes. Petitioner availed the said remedy. Since appeal is pending, this Court is not expressing any opinion on merits.

The Writ Petition is accordingly disposed of at the admission stage without expressing any opinion on merits directing the appellate authority to examine the appeal filed by the petitioner, as expeditiously as possible, preferably within a period of six (6)

weeks from the date of receipt of a copy of this order and after affording due opportunity to the fifth respondent, pass appropriate orders as warranted by law. There shall be no order as to costs.
