THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI WRI T PETI TI ON No.6320 of 2015 ORDER: (per SK,J) This writ petition was filed by the Government of Andhra Pradesh and its Commissioner & Director of Agriculture aggrieved by the order dated 12.03.2014 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.6533 of 2013. The said O.A. was allowed by the Tribunal following its earlier decision in O.A.No.9478 of 2011 and directing the authorities to fix the first respondent in the appropriate place of seniority with effect from 20.05.2000 being the date he passed the required test as per the Rules and to award him all consequential benefits, including notional promotion.

By order dated 11.08.2015, this Court granted interim suspension of the order under challenge.

W.V.M.P.No.1266 of 2016 was filed by the first respondent to vacate the aforestated order.

While so, Sri K.Rama Subba Rao, learned counsel for the first respondent, placed before this Court a copy of the Memo bearing No.11242/Agri-I(2)/2013 dated 27.03.2017 issued by the Government of Andhra Pradesh through its Agriculture and Cooperation (Agri.I) Department, whereby the Government stated that it had been decided to declare the probation of the first respondent in accordance with the orders issued in G.O.Ms.No.16 dated 21.01.2000 as he had passed all the required tests prescribed in the said G.O. Learned counsel would state that the Government therefore decided to abide by and implement the order passed by the Tribunal which is under challenge in this writ petition.

The learned Government Pleader also concedes that the cause no longer survives for adjudication in this writ petition. The writ petition is accordingly dismissed.

Interim order dated 11.08.2015 stands vacated.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
