This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of anticipatory bail in Crime No.135 of 2019 of III Town Police Station, Karimnagar District, registered for the offences punishable under Sections 354 and 506 of IPC.

Heard learned counsel for the petitioner/ accused, learned Additional Public Prosecutor appearing for the respondent/ State and perused the record.

In the FIR, it is inter alia stated that the petitioner/ accused, in the name of love, had been following the de facto complainant since six months while she was going to her college and returning to her house. He has even threatened her with dire consequences if she refuses his love.

Learned counsel for the petitioner/ accused would submit the petitioner/ accused is falsely implicated in this case. The allegations levelled against the petitioner are false and frivolous.

The de facto complainant expressed her love towards the petitioner and thereafter, they decided to marry. During the course of love, the de facto complainant used to demand and take money for her personal requirements from the petitioner. Subsequently, when he expressed his inability to pay the amounts, the de facto complainant bore grudge against him and lodged the present complaint with false allegations.

Learned Additional Public Prosecutor representing the respondent-State vehemently opposed to grant bail to the petitioner and prayed to dismiss the petition.

The allegations levelled against the petitioner clearly show that he had been following the de facto complainant in the name of love and he has even went to the extent of catching hold of her hand in the public. Hence, the safety of the de facto complainant is at threat. Therefore, the petitioner cannot be granted anticipatory bail at this stage.
