HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 11839 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of certiorari calling for the records relating to and connected with I.D.No.18 of 2002 on the file of the 1st respondent-Labour Court and quash the order dated 08.11.2002 passed therein to the extent of denying monetary benefits from the date of punishment, holding it as illegal and arbitrary.

Learned counsel for the petitioner has mainly contended that the Labour Court ought to have granted consequential relief of monetary benefit.

Learned standing counsel for the 2nd respondent corporation has contended that no illegality or irregularity has been pointed by the petitioner in the orders passed by the Labour Court and in the absence of the same, normally this Court should not interfere with the orders of the Labour Court.

Having considered the rival submissions made by the parties, this Court is of the considered view that the Labour Court has rightly passed the orders and denied monetary benefit to the petitioner. Further, no illegality or irregularity is pointed out by the counsel for the petitioner so as to interfere with the orders of the Labour Court. Unless and until any illegality or irregularity is pointed out by the

learned counsel for the petitioner in the impugned orders, this Court cannot interfere with the findings of the Labour Court. There are no merits in the writ petition and the same is liable to be dismissed. Accordingly, the writ petition is dismissed. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed. No order as to costs.
