Smt. Mugada Simhachalam, v. The State Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.43113 OF 2015 ORDER:
Heard.
The prayer in the Writ Petition is a mixed one which relates to rejection of the application of the petitioners for grant of pattadar pass books and title deeds under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act, 1971'). The petitioners also seek a direction that an enquiry be conducted in terms of the Andhra Pradesh (Andhra Area) Abolition of Inams and Conversion into Ryotwari Act, 1956 (for short, 'the Act, 1956'). Since both the Acts are entirely different and particularly when the petitioners have not yet made any application under the Act 1956, no relief can be granted to them.
So far as the rejection of the petitioners request for grant of pattadar pass books and title deeds under the impugned endorsement is concerned, the petitioners have an efficacious alternative remedy under the Act, 1971. Hence, the Writ Petition is disposed of giving liberty to the petitioners to avail the efficacious alternative remedy available under the Act, 1971 against the impugned endorsement and also to make an appropriate application under the Act, 1956. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
