THE HON'BLE SRI JUSTICE M. LAXMAN Crl. Petition No.4766 of 2023 ORDER:

This Criminal Petition is filed by accused No.1 to 9 under Section 438 of Cr.P.C. seeking anticipatory bail in connection with the FIR No.78 of 2023 on the file of the Station House Officer, Dandepalli Police Station, registered for the offence punishable under Section 306 read with Section 34 I.P.C.

The sum and substance of the prosecution case is that the daughter of petitioners 1 & 2 by name Yembadi Saieshma and the son of de facto complainant by name Nalimela Vinay Kumar fell in love with each other three years ago. Later, on 18.03.2023 the said Saieshma allegedly committed suicide by consuming pesticide. Her parents have registered a criminal case against the said Vinay Kumar and a protest was also made with the deadbody of the deceased-Saieshma. After release of Vinay Kumar from jail, the petitioners bore grudge against him and allegedly harassed him and therefore, on 16.05.2023 the said Vinay kumar also allegedly committed suicide by

consuming paraquat pesticide. The mother of deceasedVinay Kumar has registered the present criminal case against the parents of Saieshma and other villagers, who are the present petitioners herein.

The learned Public Prosecutor opposed this Criminal Petition.

As seen from the First Information Report, there is no specific reference about the abuses in the initial complaint. Even there are abuses also, there was time to receive the emotions created out of the abuses. Both the deceased persons were oversensitive to the situations. Therefore, the request of the petitioners for anticipatory bail can be considered.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:

(i) The petitioners/accused Nos.1 to 9 are enlarged on bail in the event of their arrest in connection with FIR No.78 of 2023 on the file of the Station House Officer, Dandepalli Police Station on their

executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of concerned Station House Officer. (ii) The petitioners/accused Nos.1 to 9 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
