HONOURABLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No. 6874 OF 2011 O R D E R :
This Criminal Petition is filed under section 482 of Cr.P.C., seeking to quash the proceedings in P.R.C.No. 36 of 2010 on the file of III-Additional Chief Metropolitan Magistrate, Hyderabad.
2. Heard the arguments of Sri K. Suresh Reddy, learned counsel for the petitioner/A-1, learned Public Prosecutor representing the respondent No.1/State and Sri B. Vijaysen Reddy, learned counsel for the respondent No.2.
3. The learned counsel for the petitioner/A-1 submits that A-1 to A-6 are alleged to have committed the offences punishable under section 498-A and 306 of I.P.C., and charge sheet was filed. To quash the proceedings, the petitioners/A-2 to A-6 have filed Criminal Petition before this Court and the proceedings are quashed against them. The defacto-complainant, aggrieved by the order dated 27/3/2012 passed by this Court in Crl.P.No.8916 and 10547 of 2010 has approached the Hon'ble Supreme Court by way of Special Leave [Crl.] Nos. 7183 of 2012. In the Hon'ble Supreme Court, the parties have settled the matter. In the order dated 25/07/2016, the observation of the Hon'ble Supreme Court is as under :
" We also record that all the criminal cases pending between the parties against each other shall stand quashed including Crl.P.No. 6874 of 2011. Like wise, the respective parties agree to withdraw civil cases which are pending against each other. In nutshell, all kinds of litigation between the parties, which include Ankit Aggarwal as well, have been resolved and have come to an end in view of the aforesaid settlement, inas-much as this settlement is arrived at by the parties, who are present in the court namely; petitioner-Shiv Prakash Bansal, Nitin Bansal [Mama], Ankit and all the private parties."
" The Special Leave Petitions stand disposed of in the aforesaid terms."
4. The learned counsel for the petitioner submits that in view of the settlement before the Hon'ble Supreme Court, the proceedings in Criminal Petition No. 6874 of 2011 have been quashed, and therefore, no orders are required in this criminal petition.
5. The learned Public Prosecutor and the learned counsel for the respondent No.2 have not raised any objection in the said submission.
6. Hence, this Criminal Petition is dismissed as closed and all further proceedings in this Criminal Petition have been closed in the light of the findings of the Hon'ble Supreme Court in Special Leave to Appeal [Crl.] No. 7183 of 2012, dated 25/07/2016.
7. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
