The petitioner, who is accused No.5, preferred the present Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.), seeking to relax the condition of directing to furnish fixed deposit of Rs.50,000/- each by two sureties imposed in the order, dated 27.01.2017, passed in Crl.M.P.No.127 of 2017 by the Metropolitan Sessions Judge-cum-I Additional District & Sessions Judge, Visakhapatnam. 2.

Vide Order dated 27.01.2017, the petitioner was granted bail by the Metropolitan Sessions Judge-cum- I Additional District & Sessions Judge, Visakhapatnam, on a condition of sureties furnishing a fixed deposit of Rs.50,000/- each drawn in the name of the Court and submit the same to the satisfaction of Additional Judicial Magistrate of First Class, Chodavaram. Learned Sessions Judge also imposed certain other conditions on the petitioner. However, feeling aggrieved by the said order to the extent of sureties furnishing a fixed deposit of Rs.50,000/- each, the present petition is preferred.

Learned counsel for the petitioner submits that petitioner is an agricultural coolie and imposition of such onerous condition virtually denied him the bail.

Learned Additional Public Prosecutor opposed the same.

In view of the facts and circumstances of the case, the order dated 27.01.2017 passed in Crl.M.P.No.127 of 2017 is modified as under:

"In stead of furnishing fixed deposit of Rs.50,000/- by each of the sureties, the petitioner/A.5 herein shall be released on bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees fifty thousand only) with two local solvent sureties for a like sum each to the satisfaction of Court concerned. All other conditions shall remain unaltered."
