HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3911 of 2018 ORDER:

This Criminal Petition is filed by petitioners/A1 & A2 under Section 482 Cr.P.C, to quash the proceedings against them in Crime No.51 of 2018, of Gachibowli Police Station, registered for the offences under Sections 406, 420 & 506 r/w 34 IPC.

Learned Additional Public Prosecutor would submit that investigation is in the nascent stage and statement of the complainant alone is recorded so far. In that view of the matter, let the investigation shall lead to its logical conclusion.

Hence, the Investigating Officer shall proceed with the investigation. However, having regard to the nature of the charging Sections i.e., 406, 420 and 506 r/w 34 IPC, which are punishable either up to or less than 7 years, the investigating officer shall strictly follow the guidelines rendered by the Hon'ble Apex Court in Arnesh Kumar V. State of Bihar1 and follow the procedure contemplated under Section 41-A Cr.P.C., during the course of investigation. Petitioners/A1 & A2 in turn are directed to cooperate with the investigating agency for smooth completion of investigation. Accordingly, the Criminal Petition is disposed of.
