Heard learned counsel for the petitioners and learned Government pleader for Revenue.

Petitioners claim to be owning land to an extent of Ac.4.90 cents in Sy.No.251 in Boddapuvanipalem Village, E.Bonangi, Parvada Mandal, Visakhapatnam District. This writ petition is filed apprehending that the land in their occupation and possession is now identified for construction of houses for weaker sections and there is threat of dispossession. No material is placed on record to show that the land is owned by the petitioners. Learned counsel for the petitioners fairly submits that the said land is Government land and the petitioners are in occupation and enjoyment and this piece of land is the only source of their livelihood. However, no material is placed on record to show that petitioners are in occupation and cultivating the land and that this piece of land is identified for construction of houses for weaker sections and petitioners are sought to be dispossessed. Therefore, as of now, the cause agitated in the writ petition is pre-mature and the writ petition is in the form of pre-emptive litigation. 3.
Accordingly, the Writ Petition is dismissed. However, it is open for the petitioners to work out their remedies as and when any action is taken dispossessing them, subject to petitioners in possession of land described in the writ petition. There shall be no order as to costs.
