SHANKAR NARAYANA WRIT PETITION No.31337 of 2015 ORDER : (Per Justice R.Subhash Reddy) In this writ petition, petitioner seeks directions by way of Mandamus, to declare the action of respondents in not considering his case for admission into MBBS/BDS course in the 2nd counseling scheduled to be held on 24.09.2015 under physically handicapped category, as illegal and arbitrary.

As per the notification issued by the NTR University of Health Sciences, the candidates who are claiming admission under physically challenged quota, were to appear before the Medical Board on 22.08.2015. Based on such appearance before the Medical Board, eligibility list is to be prepared and admissions are to be granted as per the merit list prepared based on the confirmation of disability certificate by the Medical Board constituted. In this case, the petitioner has obtained the physically handicapped certificate on 10.09.2015 i.e.

subsequent to examination by the Medical Board. It is also brought to our notice by the learned Standing Counsel appearing for respondents 2 and 3 that the 2nd phase of counseling is on 24.09.2015. Based on the written instructions, it is further stated that the Medical Board was consisting of four members, namely, Dr.Chandra Sekhar of NIMS as Chairman, Dr.Prasanth, Prof.

& HOD, Orthopedics, GMC, Guntur, Dr.C.V.Dasaraiah, Prof & HOD, Orthopedics, SMC, Vijayawada and Dr. K.Satyanarayana, Prof. & HOD of Medicine, SMC, Vijayawada, as members. The Medical Board, constituted with the above Doctors, has already scrutinized the claims of students for admission under

physically handicapped quota, on 22.08.2015, and as the 2nd counseling is scheduled to be held tomorrow, it is not possible for examining the claim of petitioner at this stage. For the aforesaid reasons, the writ petition is devoid of merit and it is accordingly dismissed. No costs.
