Heard learned counsel for the petitioner who submits that the lis in the writ petition is squarely covered by the order dt.25.05.2017, passed by this Court in WP.No.17279 of 2017 and the same is not disputed by the learned Assistant Government Pleader for Prohibition and Excise and learned Assistant Government Pleader for Home.
In view of the same and for the reasons alike, this Writ petition is also disposed of and the impugned notice dt.15.05.2019 is set aside. As a consequence, the detention of Smt.Maddela Mallama owing to the failure to pay the amount of penalty would also be rendered illegal. The respondent authorities shall forthwith release the detenue. However, this order will not preclude the authorities from proceeding further in the matter. No order as to costs.
