THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.42022 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner's request for grant of pattadar pass book and title deeds was declined by the Tahsildar, Yerrupalem Mandal, Khammam District, the 2nd respondent, under his Memo in Rc.No.B/1288/2015, dated 21.11.2015, on the ground that as per the report submitted by the Village Revenue Officer, the land for which the petitioner sought for pattadar pass books belongs to Reserve Forest. The petitioner questions the said Memo on the ground that without hearing her, the said Memo is given and the petitioner's vendors were already given pattadar pass books and title deeds and the sale in favour of the petitioner was also registered in pursuance of the orders of this Court in W.P.No.29775 of 2014, dated 30.11.2014.

I do not see any reason to entertain the Writ Petition as the rejection of request for grant pattadar pass books and title deeds is within the jurisdiction of the 2nd respondent and if the petitioner is dissatisfied with the said order, she has sufficient remedies available under the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971, and there is no reason to byepass the said remedies and entertain the present Writ Petition.

Hence, granting liberty to the petitioner to avail appropriate remedies available under law, the Writ Petition is dismissed. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
