2015-12-16Vilas V.Afzulpurkar1 pages

THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.40743 OF 2015 ORDER:

Heard.

The impugned order is the one passed by the appellate authority under the provisions of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short, 'the Act'). The petitioner has an efficacious alternative remedy of preferring a revision under Section 9 of the Act and the powers of the revisional authority under the Act are wide enough to correct the errors, if any, in the impugned order. No reasons, therefore, are made out by the petitioner so as to warrant entertainment of this Writ Petition against the said order. Therefore, the petitioner is at liberty to approach the revisional authority and seek appropriate interim relief against the impugned order.

The Writ Petition is accordingly disposed of with liberty to the petitioner to approach the revisional authority. If the limitation for filing revision has expired as on today, the petitioner is granted two weeks time from today to enable him to file revision and if the same is accordingly filed, the revisional authority shall entertain the same without raising the question as to limitation. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
