18.02.2022 LK,J I.A.No. 1 of 2022 This Application is filed seeking relaxation of condition No.2 imposed by this Court vide order dated 13.07.2021 whereby petitioners 1 and 2 were directed to appear before the Investigating Officer on every Monday between 10.00 A.M. and 02.00 P.M. till completion of investigation and filing of final report.

Learned counsel for the petitioners submits that the petitioners have been complying with the said condition and in view of their occupation, it has become very difficult for them to appear before the Station House Officer, hence, the said condition may be relaxed. Learned Assistant Public Prosecutor does not dispute the fact that the petitioners have been complying with the condition, however, he submits that the investigation is not yet completed.

As the condition was imposed by order dated 13.07.2021 and as the petitioners are appearing before the police, the said condition is relaxed, however, whenever the presence of the petitioners is required, the police shall issue a notice and on such notice, the petitioners shall appear before them.

The Application is ordered accordingly.
