HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.30579 of 2015 ORDER:

In view of the order proposed to be passed in this writ petition, no notice is required to be issued to the private party respondents. The grievance of the petitioner is with regard to non-consideration of his appeal bearing No.A3/6409/2014, which is pending before the 2nd respondent.

It is evident that on 06-11-2014, the 2nd respondent granted stay of the proceedings of the 3rd respondent impugned in the appeal. The petitioner, however, states that notwithstanding the said stay and pendency of the appeal, the respondents are dealing with the property and likely to create third party interest. Hence, he requests to fix an early date of hearing and the appeal be heard and disposed of.

Heard, the learned Government Pleader for Revenue. In view of the fact that the petitioner has filed appeal in the month of November, 2014 and it is pending before the 2nd respondent, I deem it appropriate to direct the 2nd respondent to fix an early date of hearing, hear all the parties concerned and dispose of the appeal on merits, as early as possible, preferably within three months from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
