THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.21208 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus and direct the 1st respondent to consider the representation of the petitioners dated 23.06.2015 and consequently cancel the No Objection Certificate issued in favour of the 2nd respondent vide L&O/M7/5686/2011, dated 30.06.2012 and consequently restrain the 2nd respondent from establishing a retail petroleum outlet at premises bearing H.No.6-1-118/A/1/1, Padmaraonagar, Musheerabad, Hyderabad."

Heard Sri P. Sri Harsha Reddy, learned counsel for the petitioners and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court.

When the matter is called today, learned Government Pleader for Home for 1st respondent has placed on record a memo No.L&O/M7/5686/2011, dated 03-07-2015. It is stated in the said memo that the representation, dated 23-06-2015 submitted by the petitioners herein has been examined, considered and rejected.

On noticing the same, learned counsel for the petitioners requested this Court to permit the petitioners to withdraw the writ petition with a liberty to assail the said memo. In view of the above, the writ petition is dismissed as withdrawn with a liberty as prayed for.

Pending miscellaneous petitions, if any, shall stand closed
