HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.2428 OF 2017 ORDR:

Sri Tera Rajinikanth Reddy, learned counsel for the petitioner, would seek permission to withdraw the present Criminal Petition, on the ground that for non-appearance of respondent No.2 - de facto complainant before the Court below when C.C.No.207 of 2016, the proceedings in which were sought to be quashed now, was taken up, the learned XV Special Magistrate Court, Erramanzil, Hyderabad, has dismissed the Calendar Case the previous day i.e., on 23.03.2017 and, therefore, the present petition becomes infructuous, but, however, to grant liberty to approach this Court, in case, the said Calendar Case is again taken on file.

2. Permission is granted.

3. Accordingly, the Criminal Petition is dismissed as withdrawn with liberty as prayed for. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
