THE HON'BLE SRI JUSTICE M. LAXMAN Crl. Petition No.4770 of 2023 ORDER:

This Criminal Petition is filed by accused No.3 under Section 438 of Cr.P.C. seeking anticipatory bail in connection with the Crime No.75 of 2023 on the file of the Station House Officer, Mandamarri Police Station, registered for the offence punishable under Section 306 read with Section 34 I.P.C.

The sum and substance of the prosecution case is that there are disputes between the husband of deceasedKoutla Laxmi and his brother with regard to two guntas of land. In this regard, a quarrel took place between the two families. On 27.04.2023, in the evening hours, accused Nos.1 to 4 allegedly went to the house of deceased and in the absence of her husband, they allegedly quarrelled with her. Again, on 28.04.2023 at 08.30 p.m., all the acused allegedly went to the house of deceased and abused her. Due to such abuses, she committed suicide by consuming pesticide poison. Therefore, the brother of deceased lodged a complaint before the police.

The learned Public Prosecutor opposed this Criminal Petition.

As seen from the First Information Report, there is no reference of the nature of abuses made by the petitioner/ A.3 and other accused and initial abuses were made by A.1 alone on the previous day of incident. Further, A.2 was arrested and enlarged on bail. A.4 was granted anticipatory bail. It appears that Anticipatory Bail Petition of A.1 is also pending. There is no specific overt act against the petitioner/A.3 and on the previous day also, the petitioner has not participated in the incident.

Accordingly, the Criminal Petition is allowed on the following terms and conditions:
(i) The petitioner/accused No.3 is enlarged on bail in the event of her arrest in connection with the Crime No.75 of 2023 on the file of the Station House Officer, Mandamarri Police Station on her executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only)
with two sureties for a like sum each to the satisfaction of concerned Station House Officer. (ii) The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 438 (2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
