Heard learned counsel appearing for the petitioner and learned Standing Counsel appearing for the respondent-Corporation.
This writ petition is filed seeking to direct the 2nd respondent to consider and pass appropriate orders on the appeal filed by the petitioner. The petitioner was appointed as Conductor on contract basis in 2008. While he was conducting the bus on 15.07.2009, a check was exercised and according to the respondent-Corporation, cash and ticket irregularities committed by the petitioner were noticed by the checking officials. Based on the report of the 2nd respondent, the 3rd respondent issued charge sheet dated 23.07.2009 and disciplinary proceedings were initiated against him. The petitioner submitted his explanation to the charges levelled against him.
Learned counsel appearing for the petitioner submits that due to ill-health, the petitioner could not attend before the Enquiry Officer. He further submits that he made a representation before the Enquiry Officer to adjourn the enquiry, but, the
Enquiry Officer without considering the same, conducted enquiry e x parte and submitted his report to the 3rd respondent holding that the charges levelled against the petitioner were proved and thereafter terminated his services.
However, the petitioner preferred appeal before the second respondent on 10-01-2013. Even though the appeal has been filed long ago, no steps have been taken by the 2nd respondent to dispose of the appeal.
Under these circumstances, the 2nd respondent is directed to hear and dispose of the appeal within a period of eight weeks from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
The Miscellaneous Petitions, if any, pending in this writ petition stand closed.
