THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.19432 of 2011 ORDER:

The petitioner in this case claims to be a Politician-cum-Social Worker. His grievance is that the police authorities did not initiate appropriate legal proceedings against a former Director General of Police of the erstwhile Andhra Pradesh State and an Inspector General of Police of the Andhra Pradesh Special Police Battalion, who were impleaded by name.

According to the averments made by the petitioner in his affidavit, ABN Andhra Jyothi, a private news channel, telecast a programme wherein it was revealed that the Inspector General of Police of the Andhra Pradesh Special Police Battalion who was impleaded eo nomine as the 8th respondent had harassed several women and abused his office. No specific averment was made against the former Director General of Police of Andhra Pradesh State who was shown eo nomine as the 7th respondent, except alleging that he had extended active support to the 8th respondent in settling civil disputes.

The petitioner however did not explain as to how he is concerned with the matter.

Upon a pointed query from the Court, Sri G.Raju, learned counsel representing Sri A.Sudhakara Rao, learned counsel for the petitioner, stated that the petitioner was acting in public interest. In that event, the petitioner has to file a writ petition in the form of a public interest litigation as per the prescribed procedure. This writ petition, which was filed as if the petitioner had a personal grievance, cannot therefore be acted upon.

The writ petition is accordingly dismissed leaving it open to the petitioner to take recourse to an appropriate remedy in accordance with law, if he so chooses.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
