HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6513 of 2013 ORDER :
The Petition is filed under Section 482 Cr.P.C by the Petitioners/A.2 to A.6 in Cr.No.144 of 2013 on the file of the Women Police Station, CCS, Hyderabad, registered for the offences u/sec. 498-A and 406 of I.P.C. and u/sec. 4 and 6 of the Dowry Prohibition Act( for short, 'the Act') on the report of the 2nd respondent-defacto complainant, to quash the proceedings in the above crime.
2) The petitioners 1,2 and 5 present. The petitioners 3 and 4 are represented by G.P.A.holder and 2nd respondent-defacto complainant is also represented by G.P.A.holder and the 2nd respondent-defacto complainant filed petitions Crl.P.M.P.Nos.13421 and 13422 of 2015 to permit her to compound the offences supra with the petitioners/accused persons as they settled the matter amicably between them.
3) On perusal of the FIR, the crime is registered for offences under Sections u/sec. 498-A and 406 of I.P.C. and u/sec. 4 and 6 of the Act. Though some of the offences are not compoundable under Section 320 of CrPC, this Court by invoking Section 482 Cr.P.C to subserve the ends of justice, permit defacto-complainant to compound offences with petitioners by allowing petition vide crl.P.M.P.Nos.13421 and 13422 of 2015.
4) Accordingly, the Criminal Petition is allowed by quashing the proceedings in Cr.No.144 of 2013 on the file of the Women Police Station, CCS, Hyderabad, against the petitioners..
