THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13202 OF 2019 O R D E R :

This writ petition is filed challenging the action of the respondent No.3 in not registering the crime against respondent Nos.4 and 5 and their henchmen, basing on the complaint of the petitioner. Learned Counsel for the petitioner states that though the petitioner gave complaint on 18.03.2019, the respondent police, deliberately, have not registered the same.

Learned Assistant Government Pleader for Home produced written instructions dated 04.07.2019 furnished by the Sub-Inspector of Police, Matwada P.S., Warangal District.

To the extent of their relevance to the present writ petition, the said instructions read as under:

" It is respectfully submitted that the petitioner Prathapagiri Govardhan gave a complaint on 18.03.2019 to the Station House Officer, Matwada Police Station stating that he purchased the land admeasuring 337.7 sq.yards in the year 2013 through registered document No.870/2013, since few days one Sambaraja Madhusudhan and others are criminally entering into his compound wall and break open the lock.

On receipt of above complaint, GD entry was made and preliminary enquiry was done, during enquiry the Station House Officer informed the petitioner to produce documents in respect of the complaint given by him, inspite of several intimations the petitioner did not produce any documents. While so, on 03.07.2019 the brother-in-law of petitioner namely Kuchana Krishna Chandra came to police station and gave the similar complaint with all

concerned documents as the petitioner Prathapagiri Govardhan was not available. On receipt of above complaint, a case was registered in Crime No.220/2019, U/s.447, 427 r/w.34 IPC of Matwada Police Station on 03.07.2019."

Recording the aforesaid written instructions the writ petition is disposed of placing the said written instructions on record. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
