THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition No.10982 of 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief/s: '....to issue an appropriate writ, order or direction more particularly one in the nature of the Writ of Mandamus, declaring the action of the respondent authorities, particularly the respondent No.2 and 3 in imposing the condition that "in case of Engineering and Pharmacy courses candidates should have completed 16 years of age as on 31st December of the year of admission", as illegal, arbitrary and against the principle of natural justice and consequently direct the respondents No.2 & 3 to allow the petitioner's daughter for submitting her application for EAMCET examination 2018 and to pass such other orders as are necessary in the interests of justice.'

I have heard the submissions of the learned counsel for the petitioner and of the learned standing counsel appearing for the 2nd respondent. Learned counsel for the petitioner would submit as follows: - 'The petitioner is the father of the student seeking admission into engineering course. As per the notification issued, on 27.02.2018, the candidate intending to appear for EAMCET examination should have completed 16 years of age as on 31st December of the year of admission. Insofar as the daughter of the petitioner is concerned, there will be a shortfall of two months sixteen days as she would be turning 16 years on 16.03.2019.

petitioner submitted a representation, dated 22.03.2018, to the respondents to relax the age condition so far as his daughter is concerned and allow her to write EAMCET-2018 examination. If a direction is given to the respondents 1 & 2 to dispose of the said representation, the ends of justice would be met.' Having regard to the facts and submissions, the Writ Petition is disposed of directing the respondents 1 & 2 to consider and dispose of the representation, dated 22.03.2018, of the petitioner as expeditiously as possible and at any rate not later than two (02) days from today. There shall be no order as to costs.
