The application under Order XXI Rules 26 and 29 CPC filed is only for seeking stay of execution and the lower Court observed that there is no other petition to seek any stay in the execution pending disposal of the main petition. When such is the case, there is nothing to interfere but for any right of filing such application is left open without going into the merits of apportionment of liability available or not.
