THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1664 of 2015 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 to 3 seeking to quash the proceedings against them in CC No.841 of 2006 on the file of the II-Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

Heard and perused the material available on record. The offences alleged against the petitioner are punishable under Sections 506 and 324 r/w.34 IPC.

A perusal of the entire record discloses that this Court called for report from the II-Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, about the stage of the matter and the delay in trial. The learned Magistrate has submitted his report stating that the delay to proceed with the trial of the case was caused due to non-service of summons on the accused and subsequently, the petitioners - accused left to Dubai as per the report of the police and A-3 is still absconding and A1 and A2 were appearing before the Court since last week of January, 2015.

Considering the facts and circumstances of the case and also taking into consideration the report of the learned Magistrate, this Court is inclined to pass the following order:

The petitioners - A1 to A3 are directed to appear on all the dates of hearing before the trial Court without fail, and the trial Court is directed to dispose of the case within a period of three (3) months from the date of receipt of a copy of this order.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, shall stand closed.
