FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE EIGHTEENTH DAY OF FEBRUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION Nos.2600 AND 2608 of 2015 BETWEEN Valmii Samaj Seva Sangh, Rep. by its General Secretary and another ... PETITIONERS AND The State of Telangana, Rep. by its Principal Secretary, Department of Home, A.P. Secretariat Building, Hyderabad and others. ...RESPONDENTS The Court made the following:
COMMON ORDER:
Heard.
2. These writ petitions are filed by the respective petitioners seeking a Mandamus against respondent No.3 for not providing protection for the purpose of construction of public conveniences besides Osmania Hospital Bus Stop, Main Road, Hyderabad, and besides Government Maternity Hospital, Petlaburz, Hyderabad, respectively.
3. In these writ petitions, respective petitioners claim that they have been granted permission by the GHMC. However, the GHMC is not a party to these writ petitions and applications are now filed by the learned counsel for
the petitioners viz., WP MP Nos.4322 and 4278 of 2015 seeking impleadment of GHMC as a party in each of these writ petitions.
3. Instructions of the learned Government Pleader from respondent No.3, however, show that petitioners never approached respondent No.3 and if they approaches respondent No.3 with necessary permissions and documents, the same would be considered by respondent No.3 and examine the same for the purpose of providing necessary police protection.
4. Since respondent No.3 is willing to consider petitioners' request for providing protection provided petitioners approach respondent no.3 with necessary permissions and documents, it is not necessary to retain these writ petitions on the file of this court and to implead the GHMC in these writ petitions.
5. Hence, both the writ petitions are disposed of permitting the petitioners to approach respondent no.3 with all the supporting documents and permissions given by GHMC and file appropriate request before respondent No.3, who shall examine the documents produced by the petitioners and take appropriate decision in the matters in accordance with law. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
