HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.3428 of 2015 in Crl.P.No.3237 of 2015 and Criminal Petition No.3237 of 2015 COMMON ORDER:

The defacto complainant-Mohd.Saliya Begum and her Counsel Sri K.Anthony Reddy, the victim girl-Mohd. Farana Begum are present.

Accused-Eramani Balaswamy and her Counsel Sri E.Venkata Reddy are present.

Heard both sides and perused the petitions.

On the report given by the defacto complainant stating that her daughter-Mohd. Farana Begum who was aged 16 years and was working in Cloth Shop has not returned home on 02.02.2014 and expressing doubt on accused who was working in the neighbouring shop and closely moving with her daughter, the police of Saroornagar P.S registered a case in Crime No.74/2014 for the offence under Sec.366-A IPC and Sec.4 and 6 of POSCO Act, 2012 and investigation is reported to be pending.

While so, today the defacto complainant, the victim girl and accused along with their respective Counsel present in Court and submitted that the victim girl and the accused have married and they begot a one year old daughter also and in view of their living peacefully

amicably as wife and husband, both defacto complainant and the victim girl have no objection for quashment of the proceedings against the accused and therefore, this Court may be pleased to accord permission to compound the offence and consequently quash the proceedings in Crime No.74/2014 of Saroornagar P.S in the interest of justice.

In view of above submission and having regard to the fact that the parties have compromised the matter and most importantly the victim girl and accused got married and attended the Court along with their one year old baby and they want to lead a happy, peaceful life and the defacto complainant has no objection for quashment of proceedings, this Court is of the view that permission can be given to parties to compromise the matter and compound the offence though the offence under Sec.366A IPC is a non-compoundable offence. Accordingly, this petition is allowed and permission is accorded and proceedings in Crime No.74/2014 of Saroornagar P.S are quashed in terms of joint compromise memo filed by the parties.

In the result, both the petitions are accordingly allowed.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
