HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.2737 OF 2017 ORDER:
Questioning the seizure of the stocks of 101 boxes of white jaggery each containing 20 kgs., total 18 quintals (wrongly mentioned as 180 quintals) by a Crime No. 2 of 2017, the present writ petition is filed.
As the petitioner had not approached the Deputy Commissioner, Prohibition and Excise who is competent authority under Section 34 of the A.P. Prohibition and Excise Act, 1968, liberty is given to him to approach the Deputy Commissioner by submitting an application for release of the above said vehicle on suitable conditions.
The writ petition is disposed of giving liberty to the petitioner to approach the Deputy Commissioner, Prohibition and Excise, Warangal who is the competent authority under Section 34 of the A.P. Prohibition and Excise Act, 1968 and submit an application for release of the above said seized goods in Crime No.2 of 2017. As and when such application is filed, the Deputy Commissioner, shall pass appropriate orders within a period of three days from the date of filing of the said application. No order as to costs.
Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
