THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.3550 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.5 for grant of anticipatory bail in the event of his arrest in connection with Crime No.285 of 2019 of Punjagutta Police Station, Hyderabad, registered for the offences punishable under Sections 354, 509, 323 and 506 read with 34 I.P.C.

Heard learned counsel for the petitioner/Accused No.1 and the learned Additional Public Prosecutor representing the respondent-State. Perused the record.

The allegations in the complaint would go to show that the petitioner/accused No.5 along with other accused forced the de facto complainant for prostitution; that on 12.06.2019, one of the accused brought the customer and asked the de facto complainant to sleep with him, for which he paid Rs.10,000/- per night; that when the de facto complainant refused for the same, the accused beat her; that thereafter the de facto complainant informed the said incident to the owner of Lisbon pub, where she is working as an Artist and Dancer, who in turn he warned the accused; that on 14.06.2019, the accused called de facto complainant and demanded her to sleep with the persons; that the accused also threatened her that they will sent her photo to one Sayeed, who kills her; that on 15.06.2019, four females and one male person came and beat her, torn her dress and attempted to kill her; that

they also robbed her gold chain and ear rings. Hence, she made a complaint to take necessary action against them. 4.

Learned counsel for the petitioner/accused No.5 would submit that the petitioner is an innocent person and falsely implicated in this case; that except accused No.2 used petitioner's name for threatening the de facto complainant, no other allegation is made against him and hence, he prays to grant anticipatory bail to the petitioner/accused No.5.

Learned Additional public Prosecutor opposed the grant of the bail to the petitioner/Accused No.5.

Having regard to the nature of allegations levelled against the petitioner/Accused No.5 and the gravity of offences, I am not inclined to grant anticipatory bail to the petitioner/Accused No.5. However, if the petitioner/Accused No.5 surrenders before the Court concerned within fifteen (15) days from today and moves an application for grant of regular bail, the same shall be decided by the Court concerned on the same day, in accordance with law. 7.

With the above direction, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
