THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.5288 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-2 to A-5 in C.C.No.377 of 2015 pending on the file of Judicial Magistrate of First Class, Suryapet, Nalgonda District, arising out of Crime No.48 of 2015 for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act. Heard the learned counsel for the petitioners/A-2 to A-5 and the learned Public Prosecutor and perused the material available on record.

After arguing for some time, the learned counsel for the petitioners confined his arguments only to the extent of dispensing with the presence of the petitioners before the trial Court. Having regard to the facts and circumstances of the case and in view of the submission made by the learned counsel for the petitioners, the petitioners/accused herein are directed to approach the trial Court and file an application under Section 205 Cr.P.C. seeking to dispense with their presence before the Court and on filing of such application, the trial Court is directed to consider the same and pass appropriate orders in accordance with law.

Subject to the above observation, the criminal petition is disposed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
