The case of the petitioner is that the petitioner institution has been granted affiliation for the intake of 240 seats in respect of B.Tech Mechanical Engineering course for the academic year 2018-2019. But, for the present academic year 2019-2020 it has made application by reducing its intake from 240 seats to 120 seats and sought approval from AICTE only for seats.

But, the 1st respondent-Jawaharlal Nehru Technological University, Hyderabad, basing on the previous approved intake and the affiliation, rejected the affiliation for the said course through the proceedings dt.14.05.2019 on the ground of shortage of faculty, which is erroneous. Aggrieved by the same, present writ petition is filed.

Learned counsel for the petitioner submits that the petitioner has made representation dt.25.05.2019 for reconsideration by taking the above anomaly into account, but the same is not being considered.

Since the petitioner made application for grant of affiliation for the year 2019-2020 only for 120 seats in respect of B.Tech Mechanical Engineering, the respondent university has

to take the student - faculty ratio basing on the intake of 120 seats, but, not basing on the intake of 240 seats. In view of the same, the impugned order dt.14.05.2019 is set aside to the extent of B.Tech. Mechanical Engineering course only, and the 1st respondent University is directed to reconsider the same by taking into account the above facts. The writ petition is allowed to the extent indicated above. No order as to costs.
