O R D E R

The case of the petitioner is that he was selected as Assistant Engineer and joined at Kothagudem Thermal Power Station, Kothagudem on 14.02.1997 and subsequently promoted as Assistant Divisional Engineer on 14.11.2002. While so, due to unavoidable personal problems, he could not attend duty since 2012. His further case is that since 2015, he has been making representations, latest being 1.8.2017, to the respondents to permit him to join duty. Aggrieved by the inaction of the 1st respondents - TSGENCO, represented by its Chairman and Managing Director, in considering his representation, the present writ petition has been filed.

The learned Standing Counsel for Telangana GENCO, on instructions, would submit that except making representation, the petitioner has not submitted any valid material in support of his claim for permitting him to join duty. Therefore, the respondents cannot be found fault with. It is settled proposition of law that in case of unauthorized absence, unless respondents initiate disciplinary action, they cannot refuse to permit the petitioner to join duty.

In view of the same, without expressing any opinion on merits, the writ petition is disposed of directing the competent authority to dispose of the representation of the petitioner dated 1.8.2017 in accordance with law and take action accordingly. No costs.
