HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.29113 of 2015 ORDER:
Heard Sri M. Ramgopal Rao, learned counsel appearing for the petitioners and Sri Bathula Raj Kiran, learned standing counsel for the respondents.
2. The 1st petitioner is the son and the 2nd petitioner is the wife of the deceased employee by name P. Venkataramana. The deceased Venkataramana, while working in the respondents-Corporation as substaff, died on 16.01.1999 due to heart attack. Consequent upon the death of the deceased employee in harness, the 2nd petitioner, who is the mother of the 1st petitioner, made application dated 16.07.1999 seeking compassionate appointment to her but she was not provided any compassionate appointment.
Subsequently, she made representation on behalf of the 1st petitioner on 24.01.2010 and 16.12.2010 to provide him compassionate appointment, but the same was also rejected by proceedings dated 01.02.2011 on the ground that the appointment can be made within three years of the death of the employee if the children are minor. The grievance of the petitioners is that since the 1st petitioner was minor, the 2nd petitioner could not submit application at the appropriate time.

In the circumstances, without going into the merits of the case, the respondent-Corporation is directed to reconsider the representations dated 24.01.2010 and 16.12.2010 of the petitioners for appointment of the 1st petitioner on compassionate grounds, in accordance with rules, and pass appropriate orders thereon, within a period of eight (8) weeks from the date of receipt of a copy of this order.
4. The writ petition is accordingly disposed of. Miscellaneous
petitions, if any, in this writ petition, shall stand closed. No order as to costs.
